Terms of Service
The following Terms of Service (TOS) must be agreed to and abided by for use of Sampreshan USA’s services. Please be aware that Sampreshan USA reserves the right to modify the Terms of Service at any time, and without notice. In addition, the use of Sampreshan USA’s service (s) by a subscriber constitutes an unconditional acceptance of and agreement to Sampreshan USA’s TOS.
DESCRIPTION OF SERVICE
Sampreshan.org is a New York based community media portal.
Sampreshan.org provides users with access to its news services, including articles, literature, audio/video contents, various forums, and blogs. You also understand and agree that the service may include advertisements and that these advertisements are necessary for Sampreshan USA to provide the service. Most of our services are free of charge. If there is a fee for a service we will publish the rate in appropriate section of this site or you can obtain it by writing us at: sampreshanusa@gmail.com
Subscriber should be aware that Sampreshan USA may proactively change the specified advertisements rates and charges from time to time, with any new rate or changed pricing being exclusively effective for new subscribers or service plan changes. Subscriber is aware that rates and offers can change upon service plan modification or new account subscription and may or may not be available for purchase at any time in the future. However, existing subscriptions will not be affected by changed pricing or offers.
MEMBER ACCOUNT, PASSWORD & SECURITY
You will receive a password and account designation upon completing the service’s registration process. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify Sampreshan of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. Sampreshan USA will not be liable for any loss or damage arising from your failure to comply with this section.
CONTENT/COMMENT REMOVAL
You acknowledge that Sampreshan USA may or may not pre-screen content, but that Sampreshan USA shall have the right in its sole discretion to pre-screen, refuse, or move any content that is available via the services.
Sampreshan USA reserves the right to refuse, revoke or remove the content (content refers to information, data, text, documents, software, music, sound, photographs, graphics and video), logo, link, advertisement for any reason without prior notice or in the exercise of its sole discretion regarding material which it finds to be objectionable. This may include, but not be limited to verbal and/or graphic obscenity, adult (pornographic content), violent, intolerant, racially biased, denigrating, or sexually oriented content or materials. This includes national / international security threats, religious conflict, gender bias, alcoholic beverages, tobacco, gambling, firearms or illegal information or violation of any international, USA and Nepal laws.
We regularly edit or remove comments that violate our Terms of Use rules. Be respectful toward others while commenting. Our comment module is not moderated before publishing. This is done because we want any useful comment/correction/info be added in the news as soon as possible. Moderation means human editor has to go through all readers’ comments before it is published which may lead to delay in disseminating content that may be very useful. Our this practice is widely used by mainstream media in the USA or around the world.
PAYMENT & FAILURE TO PAY
Establishment of the service is dependent upon receipt of payment of stated charges by Sampreshan USA. Subsequent payments are due on the anniversary date of the month for that month’s service or whichever is the selected billing cycle.
Sampreshan USA may temporarily deny or terminate service upon the failure of the subscriber to pay the charges when due. Such termination or denial will not relieve the subscriber of responsibility for the payment of all accrued charges and any collection fees.
ACCOUNT CANCELLATION
A subscriber may cancel his/her account at any time by writing to Sampreshan USA. The cancellation will take effect immediately and the subscriber’s account will remain active until the end of the subscription. There will be no refund if the fee has paid by the subscriber.
SUBSCRIBER ACKNOWLEDGEMENT
Subscriber acknowledges that the service provided is of such a nature that the service can be interrupted for many reasons other than the negligence of Sampreshan USA or its host company. Therefore, subscriber agrees that Sampreshan USA shall not be liable for any damages arising from such causes beyond the direct and exclusive control of Sampreshan USA or its host company.
DISCLOSURE TO LAW ENFORCEMENT
The TOS specifically prohibits the use of our services for illegal activities. Therefore, subscriber agrees that Sampreshan USA may disclose any and all subscriber information including assigned account history, account use, etc. to any law enforcement agency that requests such information, provided they posses the proper court-approved warrant, without consent or notification to the subscriber. Subscriber must provide Sampreshan USA real and current contact information such as e-mail address, snail mail address, telephone and fax contacts.
APPLICABLE LAW
This TOS is subject to the governing laws of the State of New York, USA.
YOUR OBLIGATIONS FOR REGISTRATION
In consideration of your use of the service, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of the United States and Nepal or other applicable jurisdiction. You also agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the service’s registration.
PRIVACY POLICY
Registration data and certain other information about you is subject to our Privacy Policy. When you register or write comment at Sampreshan USA we ask and collect your information such as name, email address, birth date, gender, PO Box No. or zip code, occupation, organization, website, ip address etc.
Sampreshan USA does not rent, sell, or share personal information about you with other people or with nonaffiliated companies except when needed to provide the products or services you have requested, when we have your permission, or under the following circumstances: We provide the information to trusted partners who work on behalf of, or with, Sampreshan USA under our confidentiality agreements. These companies may use your personal information to help Sampreshan USA communicate with you about offers from Sampreshan USA.
We respond to subpoenas, court orders, or legal process, or exercise our legal rights or defend against legal claims; We believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, situations involving potential threats to the physical safety of any person, violations of Sampreshan USA’s terms of use, or as otherwise required by law.

JURISDICTION & LEGALITY OF CONTENT
Considering the global nature of the internet, you agree to comply with all local rules regarding online conduct and acceptable content. Sampreshan USA and its dba domains’ database is hosted by WIX and is maintained in reference to the protections afforded under local and federal laws. Laws in your country or jurisdiction may not protect or allow the same kinds of speech or distribution. Sampreshan USA does not encourage the violation of any laws; and cannot be responsible for any violations of such laws, should you link to this domain, website, or use, reproduce, or republish the information contained herein.
The TOS constitutes the entire agreement between you and Sampreshan USA and governs your use of the services.
